Update on E-Filing System | Viewing of Documents in the E-Filing System

The Director of the E-Court Division of the Federal Court of Malaysia, Hamidah binti Mohamed Deril, has extended to us a notification (by WhatsApp) entitled “Paparan Dokumen dalam Sistem E-Filing”.

We would like to highlight to Members the following:

(1) Starting from 15 Oct 2020 (Wednesday), Members may view the documents that they have filed for cases in which his/her law firm is the solicitor on record.  Members may also view all court enclosures, including documents filed by the other party;

(2) If there is a change in solicitor, Members may only view their own filings and will no longer have access to the documents filed by the other party and the new solicitor;

(3) For cases not represented by the law firm, lawyers would have to a do a case search as per standard practice in order to view the documents; and

(4) Documents pertaining to criminal cases, adoption cases, or documents that have been expunged by the Courts cannot be viewed in the e-filing system

Paparan Dokumen dalam Sistem E-Filing

Mulai 15 Oktober 2020, pihak-pihak akan dapat melihat paparan dokumen kertas kausa (Enclosures) yang difailkan di mahkamah,  sama ada dokumen tersebut adalah dokumen yang difailkan sendiri ataupun yang difailkan oleh pihak lain dalam ruangan Butiran Pemfailan atau semasa sesi e-Review. Dokumen bagi kes jenayah, kes anak angkat atau dokumen yang telah diperintahkan supaya tidak dipaparkan (expunged) oleh Mahkamah, tidak akan dipaparkan dalam sistem e-Filing. Untuk butiran lanjut, sila rujuk “Manual Fungsian Paparan Dokumen Dalam EFS” yang disediakan di MENU dalam sistem e-Filing.

Peguam hanya boleh melihat dokumen yang difailkan sendiri sahaja bagi kes yang firma guaman tersebut merupakan solicitors on record untuk kes tersebut.  Bagi kes yang tidak diwakili oleh firma guaman tersebut, peguam perlu buat carian kes seperti biasa untuk mendapatkan dokumen.
