Permitted Descriptions on A Law Firm’s Letterhead (Circular No 155/2021)

Circular No 155/2021
Dated 6 May 2021

To Members of the Malaysian Bar

Permitted Descriptions on A Law Firm’s Letterhead

The Bar Council Legal Profession Committee (“LPC”) has been receiving queries on whether the words “Syarie Counsel” can be included on a law firm’s letterhead.

Please be informed that the words “Syarie Counsel” can be included on the law firm’s common letterhead where the names of the branch offices are stated.  However, the words “Syarie Counsel” cannot be included on the law firm branch’s letterhead if there is no Syarie Counsel based at that branch.  There must be an indication of where the Syarie Counsel is based at if the words “Syarie Counsel” is included on the law firm’s common letterhead (eg: Syarie Counsel (Selangor)).

Example:

Firm Messrs XYZ has three branch offices: A, B and C.  The Syarie Counsel is based at branch A.

The firm can include the words “Syarie Counsel” on the law firm’s common letterhead where the names of the branch offices are stated, with the indication of where the Syarie Counsel is based at.

Branch A can include the words “Syarie Counsel” on branch A’s letterhead.

Branch offices B and C cannot include the words “Syarie Counsel” on their letterheads.
