Invitation to Serve on Panel of Solicitors for the
Malaysian Bar Professional Indemnity Insurance

At the request of the Bar Council, the Insurer for the Malaysian Bar Professional Indemnity Insurance (“PII”) Scheme has agreed to enlarge the present panel of solicitors for the PII Scheme, to overcome the shortage of panel solicitors in certain states and/or certain areas of practice.

Members of the Bar are invited to serve on this panel of solicitors, to handle claims relating to the PII Scheme.  Please note that the Bar Council is not involved in the selection of and appointment to the panel of solicitors for the PII Scheme.  The Bar Council is only assisting the Insurer to compile a list of applicants to consider as panel solicitors.  The Insurer will contact successful applicants directly to provide the guideline as a panel and fee scale.  In the meantime, the Insurer has informed the Bar Council of the following:

(1) The appointment as a panel solicitor is personal to each Member (not to the law firm);

(2) Once appointed as a panel solicitor, the Member must be able to personally handle assignments, since the appointment is personal to that Member.  Any tasks that are delegated must be personally supervised by the Member; and

(3) As a panel solicitor, he/she is not conflicted from acting in matters against financial institutions.

If you are interested to be empanelled on the panel of solicitors for the PII Scheme and are able to commit to doing so, please write in to the Bar Council with the following information, on or before 30 Dec 2020 (Wednesday)

(1) Seniority and experience in insurance claims in general, and PII claims in particular;

(2) Familiarity with the structure of the PII Scheme and policy documents;

(3) Familiarity with relevant legislation and case law including, in particular, cases concerning professional indemnity claims made policies;

(4) Particular areas of specialisation, eg banking, bankruptcy, civil / criminal litigation, conveyancing, construction, corporate / commercial / M&A, cybersecurity, intellectual property / trademarks, and maritime / shipping, etc.
