Documents That Can Be Accepted for Filing of Pupillage Documents

The Bar Council has received an email dated 28 July 2020 from the Deputy Registrar of the Kuala Lumpur High Court regarding the submission of documentary evidence of a pupil’s qualification.

Under section 15(3)(a) of the Legal Profession Act 1976 (“LPA”), a pupil who is applying to the High Court for admission and enrolment as an Advocate and Solicitor is required to submit, among others, true copies of any documentary evidence showing that he/she is a qualified person.

It has come to our attention that pupils are unable to obtain and submit the required certificates / transcripts issued by the Legal Profession Qualifying Board (“LPQB”) and the Inns of Court as a result of the COVID-19 pandemic.

The Court has agreed that in lieu of these documents, pupils can submit the Petition (Form 1) and the Affidavit (Form 6) together with an explanatory letter from their university in respect of barristers and a letter of release from LPQB in respect of CLP graduates.

The Bar Council has, in its letter dated 30 July 2020, requested LPQB to render their kind cooperation to the pupils and issue them the requisite letters.

DOKUMEN YANG BOLEH DITERIMA MAHKAMAH BAGI MENGGANTIKAN SIJIL CLP DAN BARRISTER UNTUK PEMFAILAN PETISYEN KEMASUKAN PEGUAM

Dengan segala hormatnya saya merujuk perkara di atas.

2. Saya dimaklumkan terdapat banyak aduan yang dikemukakan kepada pihak Majlis Peguam Malaysia berkenaan Borang 1 dan Borang 6 yang tidak diterima pemfailannya di Mahkamah Tinggi kerana tidak disertakan dengan bukti kelayakan sebagaimana keperluan Seksyen 10 Akta Profesion Undang-Undang 1976 (Akta 166), khususnya daripada Graduan Barrister di UK dan Graduan CLP berikutan Pandemic Covid-19 yang menyebabkan transkrip atau sijil kelayakan tidak dapat diekstrak dari UK.

3. Bahagian Kuasa-Kuasa Khas (BKK) Mahkamah Tinggi Kuala Lumpur, setelah konsultasi dengan YA Hakim dan makluman kepada Pendaftar Mahkamah Tinggi Malaya, bersetuju untuk menerima pemfailan Borang 1 dan Borang 6 yang disertakan dengan surat daripada universiti yang menerangkan mengenai Barrister tersebut dan surat pelepasan yang terkini daripada LPQB. Oleh itu, dipohon kerjasama pihak tuan/puan untuk memanjangkan makluman ini kepada pempetisyen dan pihak LPQB untuk tindakan selanjutnya.
