Notification of Court Operations During the
Conditional Movement Control Order Period in Selangor, Kuala Lumpur and Putrajaya

We draw Members’ attention to the announcement by the Senior Minister and Defence Minister, YB Dato’ Sri Ismail Sabri Yaakob, yesterday (12 Oct 2020), on the enforcement of the Conditional Movement Control Order (“CMCO”) in Selangor, Kuala Lumpur, and Putrajaya, beginning from tomorrow, 14 Oct 2020, the media statement (available here) issued by the Chief Secretary to the Government, Tan Sri Mohd Zuki bin Ali, yesterday (12 Oct 2020) entitled “Pengoperasian Perkhidmatan Kerajaan Semasa PKPB”, and Circular No 341/2020 entitled “CMCO Period in Kuala Lumpur, Putrajaya and Selangor | MITI’s COVID-19 Intelligent Management System (“CIMS”)” dated 13 Oct 2020.

The Chief Registrar of the Federal Court of Malaysia, Tuan Ahmad Terrirudin bin Mohd Salleh, has issued a media statement (see pages 4 to 6) entitled “Pemakluman Pengendalian Kes-Kes di Mahkamah Wilayah Persekutuan Putrajaya, Wilayah Persekutuan Kuala Lumpur dan Negeri Selangor Selaras Dengan Perintah Kawalan Pergerakan Bersyarat (PKPB) dari 14 Oktober hingga 27 Oktober 2020” today pertaining to court operations in Selangor, Kuala Lumpur and Putrajaya.

Effective from 14 Oct 2020 (Wednesday) until 27 Oct 2020 (Tuesday), the Federal Court, Court of Appeal, all courts in Selangor and Kuala Lumpur, and all lower courts in Putrajaya will be adhering to the following guidelines:

         (a) Suspension and Postponement of Hearings of All Civil and Criminal Cases

  • Cases are to be handled in accordance with the “Panduan Pengendalian Kes-Kes di Mahkamah Seluruh Malaysia Berikutan Perintah Kawalan Pergerakan di bawah Akta Pencegahan dan Pengawalan Penyakit 1988 dan Akta Polis 1967 (“Guidelines A”), which was issued on 17 Mar 2020.
  • Guidelines A is available here (see pages 7 to 9) for your reference.

          (b) Operations at Office and Counter Services at the Courts
  • These matters are to be handled in accordance with the “Pemakluman Operasi Mahkamah Semasa Tempoh Kawalan Pergerakan Bersyarat (PKPB) dan Pasca Perintah Kawalan Pergerakan (PKP)” (“Guidelines B”), which was issued on 3 May 2020.

    (c) Online Hearings
  • The directive issued also states that online hearings for court proceedings will adhere to the guidelines which were issued on 26 Mar and 24 Apr 2020.
