Section 17A of the Malaysian Anti-Corruption Commission Act 2009

As Members may be aware, the Malaysian Anti-Corruption Commission (Amendment) Act 2018 (“Act A1567”) introduced a new section 17A into the Malaysian Anti-Corruption Commission Act 2009 (“MACC Act 2009”).  Please click here to view Act A1567.

Section 17A of the MACC Act 2009 came into effect on 1 June 2020 and imposes criminal liability on a commercial organisation if a person associated with it offers gratification with the intent to gain advantage for the commercial organisation.

Members may refer to the “Guidelines on Adequate Procedures” issued by the Prime Minister’s Department pursuant to section 17A(5) of the MACC Act 2009, which can be accessed here.
