Fingerprint Requirement on Documents Attested by Commissioner for Oaths (Circular No 120/2011)

Circular No 120/2011
Dated 3 June 2011

To all Members of the Malaysian Bar

Fingerprint Requirement on Documents Attested by Commissioners for Oaths

We refer to the letter dated 19 May 2011 from the Chief Registrar of the Federal Court to Commissioners for Oaths, a copy of which is attached.  According to the letter, the Chief Justice of Malaysia instructed all Commissioners for Oaths to ensure that deponents impress their fingerprints on register books and all attested documents.

The President of the Malaysian Bar has taken immediate steps to address this issue and the Judiciary has agreed that the fingerprint requirement will apply only to documents for use in Jabatan Pengangkutan Jalan Malaysia ("JPJ") matters thus excluding, amongst others, all court papers from the application of the letter, unless the deponent of affidavit chooses to use his or her fingerprint.

We understand that a letter of clarification will be issued shortly by the Judiciary to this effect.

Please do not hesitate to contact the Secretariat at council@malaysianbar.org.my, should you require any clarification.

Thank you.
