Sistem Pendaftaran Penghantar Dokumen Setem ("SPEDOS")

Sistem Pendaftaran Penghantar Dokumen Setem (“SPEDOS”)
 
The Bar Council Conveyancing Practice Committee (“CPC”) and the Inland Revenue Board of Malaysia (Lembaga Hasil Dalam Negeri Malaysia, “LHDNM”) have discussed the need to identify the persons who carry out the submission and collection of documents relating to endorsement of payment of stamp duty.  This is a pressing matter, especially as there have been reports of fraud, forgery and wrongful use of cheques and bank drafts.

As a follow-up measure to the discussions, LHDNM will implement Sistem Pendaftaran Penghantar Dokumen Setem (“SPEDOS”), whereby law firms are required to register, with the LHDNM, their staff, agents or service providers who are authorised to handle documents involving stamp duty.  This will allow law firms and officers at LHDN branches to identify or trace the identity of the persons who carry out the submission and collection of documents relating to endorsement of payment of stamp duty.  
 
Please note that under SPEDOS, only the registered staff, agents or service providers of a law firm are allowed to present documents for stamping on behalf of the law firm.   Exchange of documents with the registered staff, agents or service providers of another law firm, or with a third party, is not allowed.
Law firms are requested to register and to submit the following details and documents relating to your authorised staff, agents or service providers, at the Stamp Assessment and Payment System (“STAMPS”) webpage under the tab “Daftar Pengguna Baru”:

(1) Full name; 
(2) NRIC No, together with a copy of NRIC;
(3) Personal contact number;
(4) Personal email address;
(5) Personal residential address;
(6) Passport-sized photo; and
(7) Letter of confirmation and authorisation from the law firm.

Each law firm is allowed to register an unlimited number of staff, agents or service providers.  Law firms can replace, or update the details of, the authorised persons at any time by submitting the relevant details and documents.

SPEDOS will be implemented on 1 Oct 2014 (Wednesday).  Please submit the details and relevant documents before this date as LHDNM will only deal with the registered persons from the date of implementation.
