Misuse of the Appointment System at Various Land Registries and District Land Offices (Circular No 3

Circular No 352/2021
Dated 6 Sept 2021

To Members of the Malaysian Bar

Misuse of the Appointment System at Various Land Registries and District Land Offices

It has come to our attention that there are Members who are misusing the current appointment system at various land registries and district land offices.  This involves, inter alia, failing to show up for the appointments chosen by Members or allocated to them and furthermore, failing to cancel the unwanted appointments.

Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan has informed us that in the month of July 2021, a total of 341 appointments involving 196 firms have been cases of “no-show”.

It has also come to our attention that the Penang Bar Committee has informed its members on the wastage of appointment slots at Pejabat Pengarah Tanah dan Galian Pulau Pinang via Penang Bar Committee's Circular CPC 11/21, while the Johore Bar Committee has also done the same via its Circular No. 77/2021 and Circular No. 72/2021 on instances of inaccurate submission of information requested by Pejabat Tanah dan Galian Johor, thus leading to appointment slots going to waste.

We understand that some Members are facing difficulty securing appointment slots due to the limited number of slots available at each land registry and district land office.  However, if Members do not show up for their appointments or cancel them on a timely basis, or submit inaccurate information to the land registry or district land office, the limited appointment slots will go to waste.  In effect, it is an abuse of the system and deprives other Members of the opportunity to present at the same land registry and also delays the completion of transactions.

We urge Members to be considerate during these trying times and to be mindful of fellow Members.  Therefore, please attend all appointments made or cancel them on a timely basis to free up the slots so other Members may secure an appointment.

Thank you.
