Necessity of Complete Information in List of Assets for Application for
Registration as Representative (Schedule 22 of Federal Territory of Kuala Lumpur
Land Rules 1995), and Supporting Documents for Presentation Involving Companies

(1) Necessity of Complete Information in the List of Assets for Application for Registration as Representative (Schedule 22 of the Federal Territory of Kuala Lumpur Land Rules 1995)

The Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur (Federal Territories Director of Lands and Mines Office Kuala Lumpur, “PPTG WPKL”), has informed us, in its email dated 7 Nov 2019, of instances where submission under Schedule 22 of the Federal Territory of Kuala Lumpur Land Rules 1995 was rejected on the basis of incomplete information in the List of Assets.

Members must conduct proper due diligence to ensure all the information required by PPTG WPKL is reflected in the List of Assets.  Any List of Assets that does not contain such information must be amended before submission to PPTG WPKL.

(2) Supporting Documents for Presentation Involving Companies

PPTG WPKL has also released a notification, stating that, in line with the Companies Act 2016, the only supporting document relating to the company that is needed for presentation purposes is the company search.  The company’s memorandum and articles of association, or constitution; form 24; form 44; and form 49 are not required to be submitted.  The notification is available here (see page 4).

However, for presentations involving Malay reserved land, the memorandum and articles of association, or the relevant directors’ resolution, is still required.

Dengan hormatnya saya merujuk perkara di atas.

Dimaklumkan bahawa terdapat permohonan pendaftaran wakil di dalam Jadual 22 ditolak oleh pejabat ini atas sebab maklumat hartanah di dalam senarai aset tidak lengkap.

Sehubungan dengan itu, pejabat ini memohon kerjasama pihak tuan/puan untuk memaklumkan firma guaman supaya membuat semakan terlebih dahulu untuk mendapatkan maklumat terkini hartanah sebelum permohonan senarai aset difailkan di Mahkamah.  Semakan yang dicadangkan ialah melalui permohonan carian persendirian, semakan dengan pemaju/pemilik tanah atau Perbadanan Pengurusan.

Maklumat lengkap yang perlu dinyatakan adalah seperti berikut:-

Mana-mana senarai aset yang tidak dinyatakan maklumat yang lengkap, hendaklah dipinda terlebih dahulu sebelum serahan dibuat ke pejabat ini.

Bagaimanapun, bagi senarai aset yang dikeluarkan sebelum tarikh pendaftaran hakmilik strata, senarai aset hendaklah menyatakan maklumat lengkap hakmilik induk.  Pihak penyerah hendaklah mengemukakan surat pengesahan pemaju bersama perserahan pendaftaran wakil (Jadual 22) bagi kes seperti ini.

Bersama ini disertakan ringkasan untuk rujukan.  Kerjasama tuan/puan untuk membuat hebahan berkenaan perkara ini amat dihargai.
