Exemption on the Use of Old Seals by Commissioners for Oaths and Other Matters (Circular No 100/2018

Exemption on the Use of Old Seals by Commissioners for Oaths and Other Matters: Information from PPTG WPKL

The Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur (Federal Territories Director of Lands and Mines Office Kuala Lumpur, “PPTG WPKL”) has informed us, in an email dated 5 Apr 2018, of the following matters.

(1) Use of Old Seals by Commissioners for Oaths

PPTG WPKL has obtained clarification from the Courts in respect of Rule 21(1) of the Commissioners for Oaths Rules 2018 relating to the savings provisions.  Accordingly, PPTG WPKL’s official stand is that it will allow the usage of the old seals by the Commissioners for Oaths until 31 Dec 2018 or until the end of the period of appointment of the said Commissioners.  Any firm that had documents rejected on the basis of non-compliance with the Commissioners for Oaths Rules 2018 regarding the use of the new format for the seals, are advised to write officially to PPTG WPKL for a waiver of the registration / presentation fees.  

(2) Filling of Entry of Private Caveat Forms

As regards the filling of the entry of private caveat forms (“Form 19B”) executed on or after 1 Jan 2017, Members are advised to take note that the last known address of the proprietor has to be included in paragraph 4 of Form 19B.  Beginning from April 2018, PPTG WPKL will reject forms that are not in compliance with the statutory format.  A copy of Form 19B was circulated as one of the attachments in Bar Council Circular 200/2017 dated 13 Sept 2017, entitled “Update on National Land Code (Amendment of First and Fifth Schedules) Order 2017”. 

This approach is in line with section 323(2) of the National Land Code 1965 — as amended by the National Land Code (Amendment) Act 2016 (Act A1516) — which came into force on 1 Jan 2017 and provides as follows:

“(2)   Any such person or body wishing to apply for the entry of such a caveat shall do so in Form 19B and such application shall be attested in accordance with the provisions of section 211 notwithstanding that the provisions dealt with dealings in alienated land, and shall state therein the nature of the claim on which his application is based, and whether the caveat is to be expressed to bind the land itself or an undivided share in the land or a particular interest onlyand the last known address of the proprietor if the caveat is to be expressed to bind the land itself or an undivided share in the land.” [Emphasis added] 

(3) Stamping of Discharge of Charge Forms

As regards the stamping of the discharge of charge forms (“Form 16N”), PPTG WPKL will reject forms where no information is displayed in the “Property / Instrument Description” section of the stamp certificate.  The Inland Revenue Board of Malaysia (Lembaga Hasil Dalam Negeri, “LHDN”) has advised that every user of the Stamps Assessment and Payment System (“STAMPS”) is required to choose / complete the “Penyeteman Sekuriti” section on the STAMPS portal to ensure that the details of ownership are shown on the stamp certificate of Form 16N. 

(4) Update of Email Address and Application for Online User ID

In an effort to improve its services by adopting a paperless approach, PPTG WPKL will cease sending notification letters informing of presentation details, by post to law firms beginning from May 2018.  Such letters will only be sent by email.  Further, users can check the status of presentation of documents via the user’s screen or the “e-Semakan” section of the PPTG WPKL’s official portal (www.ptgwp.gov.my).  In this respect, all Members who have dealings with PPTG WPKL are encouraged to apply for an online user ID and to update their email addresses, if they have not already done so, at https://www.ptgwp.gov.my/etanah-awam/AwamLoginForm.xhtml?target=kl.

Pengecualian Penggunaan Cop Meterai Pesuruhjaya Sumpah dan Makluman Lain

Dimaklumkan bahawa pejabat ini telah mendapat penjelasan daripada Mahkamah berkenaan pengecualian di bawah Kaedah 21(1) Kaedah-Kaedah Pesuruhjaya Sumpah 2018 melibatkan penggunaan cop pesuruhjaya sumpah. Oleh itu, pejabat ini telah menerima surat akuan yang menggunakan cop pesuruhjaya sumpah yang lama sehingga 31 Disember 2018 atau sehingga tamat tarikh lantikan Pesuruhjaya Sumpah yang berkenaan. Mana-mana firma yang telah ditolak permohonannya atas sebab tersebut boleh memohon secara bertulis ke pejabat ini untuk pengecualian bayaran pendaftaran/serahan semula.

Selain itu, dimaklumkan juga beberapa pemakluman seperti berikut untuk makluman dan hebahan.

  1. Pengisian Borang Kaveat Persendirian (19B)

Akta Kanun Tanah Negara (Pindaan) 2016 [Akta A1516] telah dikuatkuasakan mulai 1 Januari 2017 melalui P.U (B) 531/2016. Salah satu pindaan yang terlibat adalah seksyen 323(2) seperti berikut:-

“(2) Any such person or body wishing to apply for the entry of such a caveat shall do so in Form 19B and such application shall be attested in accordance with the provisions of section 211 notwithstanding that the provisions dealt with dealings in alienated land and shall state therein the nature of the claim on which his application is based, and whether the caveat is to be expressed to bind the land itself or an undivided share in the land or a particular interest only, and the last known address of the proprietor if the caveat is to be expressed to bind the land itself or an undivided share in the land.”

Oleh itu, mana-mana permohonan 19B yang disempurnakan selepas 1 Januari 2017 akan ditolak sekiranya alamat terkini di perenggan 4 tidak dicatatkan. Penolakan mula dibuat ke atas Borang 19B yang diproses pada April 2018.

  1. Maklumat butiran surat cara pada Sijil Setem Borang 16N

Pejabat ini menolak permohonan Melepaskan Gadaian (Borang 16N) yang disertakan dengan sijil setem yang tidak dipaparkan maklumat hakmilik pada ruangan butiran suratcara. Pihak Lembaga Hasil Dalam Negeri memaklumkan bahawa pengguna STAMPS (Stamps Assessment and Payment System) perlu memilih/mengisi permohonan “Penyeteman Sekuriti” bagi memastikan maklumat hakmilik dipaparkan pada Sijil Setem Borang 16N.

  1. Pengemaskinian Alamat Emel dan Permohonan ID Pengguna Online

Pejabat ini kearah menambahbaik perkhidmatan melalui penjimatan penggunaan kertas (paperless). Mulai Mei 2018, pejabat ini tidak lagi akan mengeluarkan surat makluman pendaftaran perserahan kepada firma guaman secara pos. Surat makluman tersebut akan dihantar melalui emel. Selain itu, status permohonan perserahan juga boleh disemak melalui skrin pengguna atau e-Semakan (www.ptgwp.gov.my). Sehubungan dengan itu, semua firma guaman yang berurusan di PPTGWPKL digalakkan untuk memohon ID Pengguna Online serta mengemaskini alamat emel. Permohonan ID Pengguna boleh dibuat di portal https://www.ptgwp.gov.my/etanah-awam/AwamLoginForm.xhtml?target=kl.
