Mandatory CPD Scheme | Important Updates to Members of the Bar

We refer to Circular No 098/2021 entitled “Resolutions Adopted at the 75th Annual General Meeting of the Malaysian Bar on 13 Mar 2021” dated 15 Mar 2021.  The resolution regarding the Continuing Professional Development Scheme (“CPD Resolution”) was adopted during the 75th Annual General Meeting (“AGM”).

The Bar Council Professional Standards and Development Committee (“PSDC”) would like to inform Members of the Bar that the CPD Resolution has been extended to apply to Members admitted as advocates and solicitors of the High Court of Malaya between 1 July 2001 and 30 June 2006 (inclusive) (“Group Three Members”).

The CPD Resolution was to have been tabled at the 74th AGM of the Malaysian Bar held on 14 Mar 2020.  However, due to the COVID-19 situation then, the motion was withdrawn in order to expedite the conduct of the 74th AGM.  The amended motion was tabled and adopted at the 75th AGM of the Malaysian Bar on 13 Mar 2021.

The CPD Scheme for Group Three Members shall take effect from 1 July 2021 until 30 June 2022 (inclusive) for a 12-month cycle (“applicable CPD cycle”), and Group Three Members shall be required to obtain a minimum of eight CPD points during the applicable CPD cycle.

Thereafter, from 1 July 2022 onwards, Group Three Members shall be required to obtain a minimum of 16 CPD points during each subsequent 24-month CPD cycle.

If, as at 30 June 2021, any Group Three Member has obtained CPD points from the period of 1 July 2020 until 30 June 2021 (inclusive) (“eligible CPD points”) exceeding eight CPD points, the Member can carry forward the excess eligible CPD points into the applicable CPD cycle, as illustrated below:

(1) Member X has obtained two CPD points as at 30 June 2021: This Member cannot carry forward any points into the applicable CPD cycle, and shall therefore be required to obtain a minimum of eight CPD points during the applicable CPD cycle;

(2) Member Y has obtained 12 eligible CPD points as at 30 June 2021: Four eligible CPD points will be carried forward into the applicable CPD cycle; and

(3) Member Z has obtained 20 eligible CPD points as at 30 June 2021: 12 CPD points will be carried forward into the applicable CPD cycle.  This Member is therefore deemed to have complied with the requirement of obtaining a minimum of eight CPD points during the applicable CPD cycle.

The PSDC, together with the Continuing Professional Development (“CPD”) Department, have been actively organising webinars and we will continue to update Members of the Bar on the many ways to obtain CPD points in future circulars.
