YBGK and Payments to Lawyers (Circular No 198/2020)

Circular No 198/2020
Dated 25 June 2020

To Members of the Bar and pupils in chambers

YBGK and Payments to Lawyers

In recent weeks, some Yayasan Bantuan Guaman Kebangsaan (“YBGK”) lawyers have expressed concern about a delay in payments in respect of claims that they have submitted.  Some of this delay was because YBGK had not received its entire 2020 budget from the Prime Minister’s Department (Jabatan Perdana Menteri, “JPM”).

In an effort to speed up payments, the Office Bearers of the Malaysian Bar contacted and sought the assistance of various persons, including the Minister in the Prime Minister’s Department (Parliament and Law), the Minister of Finance, and the Minister of International Trade and Industry.  We take this opportunity to thank the Government for the swift cooperation we received in resolving this matter.

We have been informed by the Manager of YBGK that on 24 June 2020, the balance of the funds due to YBGK for 2020 has been received.  As a result of this, we are happy to announce that YBGK lawyers, in various states, began to receive payments for YBGK claims that they have submitted on 24 June 2020.

It is important to the Bar Council that YBGK lawyers receive prompt payment for work done by them in the service of justice and the nation.

On a related matter, the Bar Council is mindful of some disputed deductions made by YBGK in the past, in respect of claims made by YBGK lawyers.  Now that the financial situation of YBGK has improved, the Bar Council will continue to pursue and seek closure on this matter.

We thank all YBGK lawyers for the service that they have provided over the years in making access to justice a reality for thousands of persons. We hope that you will continue the important work that you are doing for YBGK in these economically trying times.

Thank you
