Submission of Unclaimed Monies to the
Unclaimed Monies Division of the Accountant General’s Department
A. Submission of Unclaimed Monies
We refer to Circular No 067/2017 entitled “Deadline to Submit Unclaimed Monies Extended to 31 May 2017”, dated 30 Mar 2017.
The Bar Council received an email from the Unclaimed Money Management Division (“UMMD”) of the Accountant General’s Department of Malaysia (“AGD”) dated 3 July 2019, stating that the deadline for submission of unclaimed monies to the Registrar (for the year ended 31 Dec 2018) was on 31 Mar 2019. As the deadline has passed, Members are urged to submit unclaimed clients’ monies to UMMD soonest possible.
Law firms should ensure that the following documents are in order for submission:
(1) Two original copies of Borang UMA-4 (Pin. 1/2018) — Serahan Wang Tak Dituntut; and
(2) One copy of Daftar Wang Tak Dituntut (Pin. 1/2018) — encrypted soft copy saved in a compact disc (“CD”); and
(3) Proof of payment to the Registrar’s bank account; and/or
(4) One original copy of Borang UMA-1 (Pin. 1/2018) — Firm’s Registration Form.

In light of the concerns pertaining to the form and details to be disclosed to UMMD with regard to submission of unclaimed monies, the Bar Council has decided that only the name and National Registration Identification Card (“NRIC”) number of the client need to be provided to UMMD.
Prior to opening a new file, Members of the Bar may wish to consider obtaining a signed form from the client consenting to the release of any unclaimed monies to UMMD, in the event that Members are unable to contact the client or do not hear from the client for more than seven years.

Selaras dengan Seksyen 10 Akta Wang Tak Dituntut 1965, adalah menjadi tanggungjawab pihak syarikat/firma untuk membuat serahan WTD (bayaran WTD dan penyerahan dokumen WTD) kepada Pendaftar WTD selewat-lewatnya pada 31 Mac 2019. Memandangkan tarikh ini telah lepas, pihak syarikat/firma hendaklah membuat serahan WTD sesegera mungkin sebelum tindakan kompaun/denda dikenakan terhadap pihak syarikat/firma. Pihak syarikat/firma perlu memastikan serahan WTD kepada Pendaftar adalah lengkap dengan perkara berikut:
- Dua (2) salinan asal Borang UMA-4 (Pin.1/2018) - Serahan Wang Tak Dituntut; dan
- Satu (1) Salinan Daftar Wang TakDituntut (Pin. 1/2018) – encrypted softcopy yang disimpan dalam Compact Disc (CD); dan
- Bukti bayarankeAkaun Bank Pendaftar; dan/atau
- Satu (1) salinan asal Borang UMA-1 (Pin.1/2018) - Borang Pendaftaran Syarikat/Firma
Disertakan bersama-sama e-mel ini adalah Garis Panduan Serahan WTD perhatian dan tindakan tuan selanjutnya.
